1. Agreement to Terms

By accessing or using skumint.com (the "Site") or any SkuMint service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use SkuMint. These Terms apply to all visitors, early access members, and future paying customers.

2. Description of Service

SkuMint™ is an AI-powered content studio for online sellers. It generates product listing content — including titles, descriptions, keywords, images, banners, Amazon A+ Content, and product videos — from a single product input. SkuMint is currently in prelaunch. Features and availability may change before the full launch.

3. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use SkuMint. By using SkuMint, you represent that you meet these requirements. SkuMint is intended for business use by online sellers and their authorized representatives.

4. Early Access

By joining the early access list, you provide your email address to receive a notification when SkuMint launches. Joining the early access list does not create a subscription, purchase, or guarantee of any specific feature or pricing. We reserve the right to modify, delay, or cancel the launch at any time.

5. Google OAuth Sign-In

SkuMint offers sign-in via Google OAuth 2.0. By signing in with Google, you authorize SkuMint to access your Google account email address and basic profile information as described in our Privacy Policy. You may revoke this access at any time through your Google account settings. SkuMint's use of Google user data is limited to the purposes described in these Terms and our Privacy Policy.

6. Acceptable Use

You agree not to use SkuMint to:

• Generate content that is false, misleading, defamatory, or violates any third party's rights.
• Violate any applicable law, including consumer protection, advertising, or intellectual property law.
• Generate content that violates Amazon's, Shopify's, or Etsy's marketplace policies.
• Scrape, reverse-engineer, or create derivative works of the SkuMint platform.
• Use SkuMint to generate spam, bulk unsolicited communications, or deceptive listings.
• Attempt to gain unauthorized access to SkuMint's systems or other users' accounts.

We reserve the right to suspend or terminate your access for violation of these rules without notice.

7. AI-Generated Content — Important Disclaimer

SkuMint uses artificial intelligence to generate content. You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or omissions. You are responsible for reviewing all generated content before publishing it.
• SkuMint does not guarantee that generated content complies with any specific marketplace's policies (Amazon, Shopify, Etsy, etc.). Compliance is your responsibility.
• SkuMint does not guarantee that generated content is free from third-party intellectual property claims. You are responsible for ensuring your listings do not infringe third-party rights.
• Generated images are AI-created and do not depict real products. Accuracy of visual representation is not guaranteed.

8. Intellectual Property

SkuMint's IP: The SkuMint platform, logo, brand, and underlying technology are owned by SkuMint and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without written permission.

Your content: You retain ownership of the product information you provide to SkuMint. You grant SkuMint a limited licence to process your input solely to generate your requested outputs.

Generated outputs: Subject to your compliance with these Terms and applicable law, you own the outputs SkuMint generates for you and may use them commercially. SkuMint makes no warranties about the originality or intellectual property status of generated content.

9. Pricing and Payment

SkuMint is currently free during the prelaunch early access period. When paid plans launch, pricing will be displayed at skumint.com and agreed to at the time of purchase. We reserve the right to change pricing with reasonable notice to existing subscribers. All prices are in USD unless otherwise stated. Payments will be processed by Stripe, subject to Stripe's terms of service.

10. Disclaimer of Warranties

SkuMint is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that generated content will meet your specific requirements or achieve any particular sales result.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SkuMint and its founder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of SkuMint, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of SkuMint shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless SkuMint and its founder from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of SkuMint, your violation of these Terms, or your violation of any third party's rights.

13. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of SkuMint shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India. For users in the UK or EU, nothing in these Terms affects your statutory rights under applicable consumer protection law.

14. Changes to These Terms

We may update these Terms as SkuMint evolves. We will update the "Last updated" date above and notify early access members of material changes by email. Continued use of SkuMint after updated Terms are posted constitutes your acceptance.
